3.3   Records available without request in terms of the Act

3.4   Records that may be requested [Section 51(1)(e)]
Records as indicated in paragraphs 3.1 and 3.2 above may be requested and shall be made available subject to the discretion of the Managing Director.
 
4.   Updating of the Manual
The Managing Director of NØVENT shall annually ensure that a review and update of this manual shall be undertaken.
 
5.   Manual made available as prescribed
The Manual shall be made available as indicated in paragraph 7 below
 
6.   Exemptions
For security, administrative or financial reasons, the Minister may, on request or of his or her own accord, by notice in the Gazette, exempt any private body or category of private bodies from any provision of this section for such period as the Minister thinks fit.
 
7.   Request procedures
The requester must use the prescribed form to make the request for access to a record. This must be directed to the Managing Director. This request must be made to the address, fax number or electronic mail address of the body concerned [s 53(1)].
The requester must provide sufficient detail on the request form to enable the Managing Director to identify the record and the requester. The requester shall indicate which form of access is required. The requester shall also indicate if any other manner is to be used to inform the requester and state the necessary particulars to be so informed [s 53(2)(a) and (b) and (c)].
The requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right [s 53(2)(d)].
If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request, which shall be subject to the discretion of the Managing Director of the private body [s 53(2)(f)].

Fees
A requester seeking access to a record containing personal information about that requester (himself/herself) is not required to pay the requisite fee. Every other requester, who is not a personal requester, shall pay the required request fee.
The Managing Director of the company shall notify the requester (other than a personal requester) by notice, requiring the requester to pay the prescribed fee (if any) before further processing the request [s 54(1)].
The fee that the requester must pay to a private body is R50. The requester may lodge an application to the court against the tender or payment of the request fee [s 54(3)(b)].
After the head of the company has made a decision regarding the request, the requester shall be notified according to the required form indicated by him/her.
If the request is granted then a further access fee shall be payable for the search, reproduction and preparation, and for any time that has exceeded the prescribed hours to search and prepare the record for disclosure [s 54(6)].
 
8.   Other information as may be prescribed [Section 51(1)(f)]
Any other such other information as may be prescribed from time to time shall be incorporated into the manual as directed by legislation or as per the latest review cycle for the Manual.  See paragraph 4 above.
 
9.   Availability of the manual [Section 51(3)]
This manual shall be available for inspection at the offices of the organisation, free of charge, and a copy has been lodged with the SAHRC.  It is also displayed on the website of the company at www.noventgas.com.
